Official Rules for The Home Depot Foundation’s Aprons In Action Program

The Home Depot Foundation’s Aprons in Action Program (“AIA Program”) is a grant program sponsored by The Home Depot Foundation, 2455 Paces Ferry Road, Atlanta, Georgia, 30339 (“Sponsor”). The AIA Program is intended to further the missions of 501(c)(3) nonprofit organizations that have previously collaborated with Team Depot on community improvement projects.
Beginning April 1, 2011 and continuing through February 29, 2012, Sponsor will select four (4) Finalists (“Finalists”) each month. The criteria for choosing Finalists will be based on the impact to the community of each eligible organization’s prior Team Depot project. Each of the Finalists will be eligible for a minimum $5,000 gift card to be used on a future Team Depot project. Visitors to Sponsor’s Facebook page will have an opportunity to vote for a first prize winner of a $25,000 gift card out of the four Finalists each month. In addition, an AIA Program grand prize winner will be selected from among each of the eleven first prize winners. The AIA Program grand prize winner will receive an additional two hundred fifty thousand dollar ($250,000) gift card to further its mission.
ELIGIBILITY: To qualify for a gift card grant, each Finalist must meet all eligibility requirements set forth in these rules and submit: (1) a written description of its past collaboration with Team Depot, including at least five (5) photographs; and (2) a written proposal for a future collaborative project with Team Depot (collectively, “Materials”). All Materials become the property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, mutilated, incomplete or illegible entries. By participating in the AIA Program, Finalists agree to release and hold harmless Sponsor and its respective parent companies, affiliates, subsidiaries, officers, directors, representatives, agents and employees, from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, 1) the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; or 2) participation in the AIA Program or any grant/prize related activities, including but not limited to traveling to or from any Team Depot project.
GRANTS/PRIZES: Only the grants specified above will be awarded. Grants are non-transferable, with no cash redemption or equivalent. All federal, state and local income taxes, insurance, licensing, registration and title fees connected to the grants are the sole responsibility of the Finalists. All federal, state and local laws and regulations apply. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of prizes awarded.
As a condition of being awarded a grant, each Finalist must complete, sign and return an affidavit of eligibility and liability and publicity release, where permitted by law, and any other applicable forms required by a taxing authority within ten (10) days of receipt of written grant notification. Further, by accepting the grant, each Finalist consents to Sponsor’s use of its name and Materials, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law. Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to Sponsor his/her grant.
VOTING: Anyone able to access the Internet and Facebook is eligible to vote for the $25,000 gift card first prize winner each month. Each person may vote one time per 24 hour period and no electronic voting is allowed. By submitting a vote, each voter agrees to consider each Finalist’s Materials and use the following criteria in placing his/her vote: (1) impact of prior Team Depot project to the community; and (2) originality of the proposed future Team Depot project. Voting will begin on the first of each month at 9:00 a.m. EDT and ends the last day of the month at noon EDT (“Voting Period”). Voters may review the Materials of Finalists and cast their votes by visiting www.facebook.com/homedepotfoundation or www.facebook.com/homedepot. Voters may vote for the organization of their choice during the Voting Period. Sponsor will tabulate and provide the results within five days after each Voting Period.
The AIA Program grand prize winner will be selected in a one-month competition based on the total number of votes received by each of the monthly first prize winners. The grand prize winner will receive a grant in the amount of $250,000, the second place winner will receive a grant in the amount of $150,000 and the third place winner will receive a grant in the amount of $100,000.
The awards results will be provided to the public on above listed The Home Depot Foundation and The Home Depot’s Facebook pages and on The Home Depot Foundation’s website at www.homedepotfoundation.org.
CHOICE OF LAW: Under no circumstances will participants be permitted to obtain awards for, and participants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, and participants further waive all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor in connection with the AIA Program, shall be governed by, and construed in accordance with, the substantive laws of the State of Georgia, without regard to Georgia conflict of law principles.
MISCELLANEOUS: By participating, each Finalist and each voter agrees to accept and abide by these Official Rules. All decisions by Sponsor regarding the AIA Program are final. Each Finalist agrees to indemnify Sponsor and its respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, managers, members, employees, agents and representatives of the above entities from any claim that its Materials infringe upon or misappropriate any third party’s intellectual property rights. Sponsor reserves the right, at its sole discretion, to suspend, modify, or terminate the AIA Program at any time.
